When I first read about you can not swim in the Conestoga River I too thought hey they can not do that because all navigable waterways belong to the people of the USA, at least that is what I remembered being taught at Edward Hand Jr. High School. As far as who is in charge of this waterway it might go all the way up to the Federal Level since the Conestoga River waterway eventually empties into the Chesapeake Bay which is clearly is interstate. What I remember from Pennsylvania History was that in the early days the Conestoga River had horse drawn barges and commerce was conducted via through the waterways to and fro from the Atlantic Ocean. The Conestoga River was one of the main elements why Lancaster became the oldest inland city in the USA. Here are some more URL links that might be of interest.

"If a body of water is navigable, it is publicly owned and may only be regulated by the Commonwealth; ownership of the land beneath would not afford any right superior to that of the public to use the waterway."
The can't do guns either as the Pennsylvania Uniform Firearms Acts tells the county they can't regulate guns - period!

CHAPTER 61. FIREARMS AND OTHER DANGEROUS ARTICLES Uniform Firearms Act

§ 6120. Limitation on the regulation of firearms and ammunition.

(a) General rule.--No county, municipality or township may in any manner regulate the lawful ownership, possession, transfer or transportation of firearms, ammunition or ammunition components when carried or transported for purposes not prohibited by the laws of this Commonwealth.

(a.1) No right of action.--

1. No political subdivision may bring or maintain an action at law or in equity against any firearms or ammunition manufacturer, trade association or dealer for damages, abatement, injunctive relief or any other relief or remedy resulting from or relating to either the lawful design or manufacture of firearms or ammunition or the lawful marketing or sale of firearms or ammunition to the public.
2. Nothing in this subsection shall be construed to prohibit a political subdivision from bringing or maintaining an action against a firearms or ammunition manufacturer or dealer for breach of contract or warranty as to firearms or ammunition purchased by the political subdivision.

(cool.gif Definitions.--As used in this section, the following words and phrases shall have the meanings given to them in this subsection:

"Dealer."
The term shall include any person engaged in the business of selling at wholesale or retail a firearm or ammunition.
"Firearms."
This term shall have the meaning given to it in section 5515 (relating to prohibiting of paramilitary training) but shall not include air rifles as that term is defined in section 6304 (relating to sale and use of air rifles).
"Political subdivision."
The term shall include any home rule charter municipality, county, city, borough, incorporated town, township or school district.

Someone else wrote that law suits are the problem. Someone drowns and then they sue the county becuase they own the park. Thatseems to be why this regs are made. If people would stop sueing for every little thing then we probably wouldn't have all these regs. I am not defending the Commissioners. The gun law isn't going to work if somkeone has a permit to carry so they can just throw that one out as RH has pointed out.

hmmm... last week the commissioners passed this resolution. This week - because - I forced a do-over - they tabled it based on the arguments I made.

Let me be clear that I made my arguments before they voted last week and they didn't listen to me. So what was the difference? I had to make a big deal about it.

What is it in people to question the motives of someone? Clearly I am right and would have won a legal suit to over-turn the bogus law. Why would you question me when I am fighting for the constitution and frankly common sense?

It seems that haters out there won't take things at face value and tear down people for what reason? Since you questioning my motives to do what is clearly the RIGHT THING - what are your motives for trying to undermine me? To what end?
