Willow Street man charged with DUI

A Willow Street man has been charged with drunken driving in connection with a one-car wreck that seriously hurt a Lancaster man, Southern Regional police reported today.

Michael T. Helm, 38, of the 500 block of Brenneman Road, was found to have a blood alcohol content level of .199 percent, police said. The wreck occurred in the 600 block of Sandhill Road, Conestoga, on Wednesday.

Helm's passenger, Donald R. Metz Jr., 26, of the 1100 block of Eshelman Mill Road, suffered serious facial and head lacerations in the crash, police said. He was not wearing a seatbelt.

Because the passenger says...hey its your car you drive.. I'm to drunk to drive... you got it buddy...??? and he jumps in crosses his fingers and holds on.. he dont get in trouble cause he's at least had the common sense not to drive himself.... its called dumb and dumber in which case dumber gets the ticket....

But I thought that only people with funny sounding last names were involved in DUIs. I'm really confused.

I guess it depends on where your standing.. at the time you hear the name Helm....?? if its funny or not...??

Such a law already exists, it's called Permitting Violation of Title. It's in the Vehicle Code, Section 1575. It's a catchall law that basically says if you permit another to drive in violation of ANY law you can be cited and the punishment will be similar. In the case of DUI the passenger would get the ticket and lose his/her license for the same period of time, and have the same fine (not to be confused with court costs). The problem is being able to prove that the passenger knew the other was unfit to drive because of alcohol. The passenger would basically have to admit to the offense. Plus the court trying the Permitting Violation of Title would be a lower court (DJ), thus the judges will likely exercise a lot more discretion. Since it is only a ticket, the cases where the police actually do charge such a violation usually won't make the paper or be reported to the paper.
